In November 2016, our client was found not guilty of impaired/over 80 and dangerous driving charges in Ottawa.

People reported a damaged high-performance car driving erratically. The car was registered to our client. Based on descriptions from witnesses and video surveillance, the police believed our client was the driver. He was arrested at home a short while after the reports.

The trial judge stayed the charges under section 24(1) of the Charter because of the flagrant violations of our client’s rights. The description the police relied on was not consistent with many our client’s physical characteristics. Arresting someone inside their home without sufficient grounds was an extremely serious breach of the Charter. The judge also excluded evidence under section 24(2) of the Charter and found him not guilty of all his criminal charges.
