Tyler was involved in car accident and arrested at his house shortly after. He was taken to the hospital, where he provided Breathalyzer samples. Tyler was charged criminally with impaired and over 80 driving.

Tyler’s job required driving and a security clearance. A conviction for drinking and driving would have cost Tyler his job. The financial cost of increased car insurance was also a concern for Tyler’s family.

We made a detailed presentation to the Crown Attorney to highlight the many problems with the prosecution’s case. As a result, all criminal charges were withdrawn in May 2014. Tyler received a Highway Traffic Act fine for a lesser non-criminal offence. While it is rare for drinking and driving cases to result in Highway Traffic Act plea bargains, it does happen.
